TK Verspätung in IST >4h

Hallo,

ich hab dazu nicht sonderlich viel gefunden.

Gebucht:
HAM-IST-PEK mit TK

der Leg: HAM-IST ohne Probleme
jedoch IST-PEK (TK20) Verspätung >4h
(STD: 0220 localtime 25.01; STA: 1625 localtime 25.01)

Abflug war schlussendlich erst um 0710 und Landung 0819.

EU Gäste recht zählt ja nicht. Weis jemand in wie weit TK hier entschädigt?

@KvR ich ging davon aus das die EU-Rechte raus sind da die Verspätung ja in IST eingetreten ist, oder irre ich da.

Du irrst dich nicht. Man muss die Flüge getrennt betrachten und da ist der zweite Abflug eben nicht mehr im EU-Geltungsbereich.

Der Bundesgerichtshof (BGH) beschäftigte sich nun in zwei Verfahren mit der Frage, ob die Ausgleichsansprüche auch bei verspäteten Anschlussflügen außerhalb der Europäischen Union in Betracht kommen (Urteile vom 13.11.2012, Az.: X ZR 12/12 und X ZR 14/12). In den entschiedenen Fällen erfolgte der Abflug planmäßig am Abflughafen innerhalb Deutschlands. Allerdings verspäteten sich die Anschlussflüge beim außereuropäischen Zwischenstopp um mehrere Stunden. Die Kläger vertraten die Auffassung, dass trotz Zwischenstopp ein einheitlicher Flug vom Abflugort zum jeweiligen Endziel vorlag und daher auch für den verspäteten Anschlussflug die EU-Fluggastverordnung anwendbar ist.


Der X. Zivilsenat des BGH entschied, dass die Ausgleichsansprüche nicht bestehen, da die Verspätung bei einem Anschlussflug eingetreten ist, den die jeweiligen Kläger außerhalb der Europäischen Union angetreten haben. Das Gericht stellte klar, dass die Anwendbarkeit der EU-Fluggastverordnung für jeden Flug gesondert zu prüfen ist, wenn eine Flugreise auch zwei oder mehr Flügen besteht, selbst wenn die Reise als einheitlicher Flug jeweils von einer Fluggesellschaft unter einer bestimmten Flugnummer angeboten wird (BGH, Urteile vom 13.11.2012, Az.: X ZR 12/12 und X ZR 14/12).

kurze Rückmeldung.
noch ist TK nicht der Meinung das ein Anspruch auf Erstattung gegeben Sei.

"...In our investigation, we have determined that TK0020 Istanbul to Beijing flight on 25th of January, 2017 was conducted with a 04-hour and 38-minute delay due to the operational conditions.
Please be informed that we are unable to compensate according to Regulation On Air Passenger Rights which is applied Turkish Civil Aviation rules (SHY Passenger) indicates that for flights which has more than 5 hours flight time or longer than 3500 kilometers, the delay time must exceed two times of the total flight time.

The ordinary services provided may not be sufficient for all of our passengers occasionally, please accept our apologies for that.....

Interessant ist jedoch das in den TK Regeln wie schon in den Post oben sehr wohl etwas anderes steht.

Delay of the flights
ARTICLE 7- (1) As of the planned departure time of a flight, the air transport operator performing the flight shall offer the following considerations to the passengers, in the event that the delay

c) is four or more than four hours for the flights longer than 3500 kilometers,

Right to compensation
ARTICLE 8- (1) When referred to this article, a compensation of Turkish Lira equivalent of 100 Euros shall be paid to passengers for domestic flights. For international flights, the passengers shall be given;

c) a compensation of the Turkish Lira equivalent of 600 Euros for all the flights longer than 3500 kilometers,

Bin ja gespannt wie das weiter geht, bzw. was ich als nächste Antwort bekomme.

Die Geschäfte laufen offenbar nicht mehr so gut in der Türkei. Wenn es die Kompensation nur noch bei Verspätungen "...twice more than flight time.." gibt, kann man davon ausgehen, dass es überhaupt keine Kompensationen bei Turkish geben wird. Falls es theoretisch doch mal eintreten sollte, wird Turkish sagen, es sei keine Verspätung, sondern der Flug sei gecancelt worden...(n)

So einfach ist es auch wieder nicht. IANAL, aber nach meinem Rechtsverständnis muss wohl der Flug, der ursächlich für die Verspätung *am Zielort* verantwortlich war, in der EU gestartet sein. Das Problem hatte ich schon mal: Abflug in TXL mit UA 45 Minuten verspätet wegen Technicals am Triebwerk, Ankunft in EWR verspätet, Anschlussflug verpasst, umgebucht auf AA, dort aber wegen Überbuchung nicht in den Flieger gekommen und erst den nächsten bekommen -> 6h Verspätung am Zielort. UA musste zahlen, auch wenn sie sich zuerst herausreden wollten.

Die ursächliche Verspätung war hier am Abflugort innerhalb der EU gegeben, und auch wenn die Verspätung nur 45min betrug, war diese doch ursächlich für die 6h Verspätung am Zielort, was einfach mal gereicht hat.

Im Fall des OP liegt es wohl etwas anders weil der EU-Flug pünktlich war, wobei ich mir durchaus vorstellen könnte, dass hier über einen der üblichen Inkasso-Dienstleister etwas zu machen wäre.

Es ist leider immer das gleiche bei TK. Als nächstes kommt dann die Ausrede, dass die Verspätung nicht im Einfluss von TK lag.

Obwohl ich Elite+ jetzt gerade nochmals letztmalig verlängere, fliege ich mit TK seit meinem letzten Rechtsstreit nur mehr um die Voucher einzulösen und wechsle jetzt wieder zurück zu MM.

Aber ohne Anwalt hast eher keine Chance.... Leider.
